Who gets the warranty refund on a defective pacemaker


Medtronic sent a credit to the hospital for my pacemaker that was defective and still under warranty. The hospital refuses to send the refund to me, even though they did not credit my bill for the replacement surgery or the replacement pacemaker.

If you paid for the pacemaker, the refund should come to you.

If the hospital paid any part of the bill, they'll keep the refund, IMO.

In Canada, the government pays the shot, so they'd keep the refund.

I'm presuming that because you had a bill, you paid the whole cost....but if it was even subsidized, they'll want the refund.

My suggestion is to cut out the chitchat with the hospital and go see a good attorney. From where I sit you not only have a refund coming from the hospital you and the hospital have one coming form Medtronic. I feel certain it swill take a good lawyer to sort out who has what coming and from whom.

hello i have a pm and defib on recall It will be hard to get any thing from medtronics Ive been consulting lawyers for over a year I had a wire on recall that broke shocking me 13 times i had my machine taken out so far so good you can email me at huskersnb1@yahoo.com put recalled pace makers in heading so it dont get deleted and I can give you the name of my attorney you can talk to him at least you got a refund i aint got squat good luck and everyone have a safe and happy holiday season may god be with us all duane

The whole medical reimbursement business is so complex that it will likely take a lawyer to sort it out. Be sure to get one who routinely handles medical cases and is willing to schedule a consultation at a reasonable cost.
Try to avoid the victim feelings about the whole thing. I would expect that the most you can expect is whatever you paid out of pocket.

Lawyers are a main reason pacemakers and medical treatment in general is so expensive in the first place.

Before getting lawyers involved, try being persistent but nice. Ask nicely, don't demand. I've found that if you are reasonable, you will almost always be treated fairly.

I would like to know what percentage of a PPM's cost is due to people using lawyers at the drop of a hat. I bet it would surprise you.

If you're nice, and they want to be jerks about it, they deserve to have a lawyer sic'd on them. You can always take a shower later. :D

Difference between refund and malpractice

I think it is important to differentiate between lawsuits for defects/malpractice, and for issues of who gets paid and how much, The first does in some cases run up the cost of devices and service. The case we are talking about in this thread is going to cost the pacemaker manufacturer the same amount no matter who gets the check. It is foolish for an individual who doesn't have the resources of the hospital to try to deal with it on their own. The hospital looks at the bottom line and you lose.

I can't get the hospital to discuss it with me. They have been very rude. I am going to file in small claims court and have the Judge figure it out. That way, it will only cost me $90 to file and I can subpoena the hospital to death.

I sued Providence Hospital for the warranty refund and I won. I am now pursuing another claim for the latest Medtronic pacemaker that failed.......
